Single-Member Court of First Instance of Evrytania – Decision No. 101/2026- Judicial Partition of Commonly Owned Real Property
Our firm successfully represented its client in proceedings before the Single-Member Court of First Instance of Evrytania concerning the judicial partition of jointly owned real property.
Τhe Court upheld the claim, finding that each of the parties owned an undivided one-quarter (1/4) interest in the disputed property. However, it concluded that an in-kind partition was manifestly impossible and economically impracticable, even without the need for a court-appointed expert. Accordingly, the Court held that the most appropriate means of terminating the co-ownership was the judicial sale of the property by public auction, with each co-owner receiving a share of the proceeds proportionate to their ownership interest. The case involved significant legal and technical complexity.
