Administrative Court of First Instance of Pyrgos (Transitional Seat of Zakynthos) – Decision No. A565/2025-Annulment of Tax Authority Forced Seizure Order
Our firm successfully represented the applicant in proceedings against the Greek Tax Authority (Independent Authority for Public Revenue – AADE), seeking the annulment of a forced seizure order imposed on the applicant’s real property for the collection of public debts.
The Court upheld the application in its entirety and annulled the forced seizure order. It further ordered the reimbursement of the court filing fee and awarded legal costs against the Greek State.
This decision reaffirms that, even within the framework of administrative enforcement proceedings, the Tax Administration is required to comply strictly with procedural safeguards and the constitutional principles protecting property rights. It highlights the importance of judicial oversight in ensuring that enforcement measures affecting private property are carried out in full accordance with the rule of law.
